VISA AND STAY PERMIT POLICIES IN ADAPTATION OF NEW HABITS (Circular Letter No. IMI-1555.GR.01.01 Year 2020)

Contents of the Circular:

  • General:
    With the enactment of the Regulation of the Minister of Law and Human Rights Number 26 of 2020 concerning Visas and Stay Permits in the Adaptation Period for New Habits, all officials and service implementers:
    1) Providing excellent service to the community;
    2) Not doing Corruption, Collusion and Nepotism;
    3) Conducting monitoring in stages;
    4) Coordinating with foreign stakeholders and guarantor related to the substance of the Regulation of the Minister of Law and Human Rights Number 26 of 2020 concerning Visas and Stay Permits in the New Habit Adaptation Period.

  • Immigration Attaché / Technical Staff / Foreign Service Officials, Head of the Immigration Division, Head of the Immigration Office, and Head of the Immigration Detention Center:
    1) Disseminate information to stakeholders and the wider community regarding:
    a) Visa and Residence Permit policies in the New Customs Adaptation Period, and
    b) Certain Immigration Checkpoints (TPI) which are designated as entrances and exits to Indonesian territory during the adaptation period for new habits;

    2) Supervise and control the implementation of Visa and Stay Permit policies in the New Habit Adaptation Period.

  • Attache / Immigration Technical Staff / Foreign Service Officer:
    1) Implementing the granting of visas effectively and efficiently in accordance with the Regulation of the Minister of Law and Human Rights Number 26 of 2020 concerning Visas and Stay Permits in the New Habit Adaptation Period;

    2) Providing a visa based on the approval of the Director General of Immigration (Visa approval) which is still valid;

    3) Foreigners who apply for a Visa must fulfill the requirements as referred to in the laws and regulations and attach the following supporting documents:

    a) a health certificate containing a statement of freedom from COVID-19 in English issued by an institution authorized by the government in each country,
    b) a statement in English stating that they are willing to enter quarantine and / or treatment at their own expense at a quarantine facility or health service facility set by the government at their own expense, if the PCR examination by the Indonesian health authority at the entrance of the country gives a positive result (+) , or there are clinical symptoms of COVID-19 according to health protocols and statutory provisions,
    c) a statement letter of willingness to carry out health monitoring during the quarantine or isolation period independently in accordance with health protocols and provisions of laws and regulations, and
    d) proof of ownership of health insurance / travel insurance which includes health financing, and / or a statement letter of willingness to pay independently if affected by COVID-19 while in Indonesia,

    4) For humanitarian reasons such as visiting / accompanying parents / siblings who are sick / dead or for medical purposes, a Visit Visa for 1 (one) trip can be issued by Immigration Officers or Foreign Service Officials at Representatives of the Republic of Indonesia by fulfilling the provisions as referred to in number 3) and attach proof of reason for visa application;

    5) For a Visit Visa applicant other than meeting the requirements as referred to in number 3), the guarantor must attach proof of availability of funds of at least US $ 10,000 (ten thousand US Dollars) or the equivalent from a financial institution or bank in Indonesia to meet the necessities of life while in Indonesia;

    6) Obligation to attach proof of availability of funds of at least US $ 10,000 (ten thousand US Dollars) or the equivalent as referred to above is calculated for one guarantor;

    7) The obligation to attach evidence of availability of funds as referred to in number 5) is excluded for aid workers, medical and food support, transportation equipment crews and humanitarian reasons;

    8) Foreigners holding Visa approval and / or Visa holders that have expired and have not entered the territory of Indonesia, are required to re-apply for a visa in accordance with statutory provisions;

    9) Non-Immigration Tax State Revenue Fee that has been paid cannot be refunded;

    10) Issuance of visas for humanitarian reasons as referred to in number 4) must be reported at the first opportunity to the Director General of Immigration u.p. Director of Immigration Traffic.

  • Head of Immigration Division:
    Conduct and periodically report on the guidance, control and supervision of the implementation of Visa and Stay Permit policies in the New Habit Adaptation Period.

  • Head of Immigration Office:
    1) Guiding the Work System and Work Pattern in accordance with the Circular of the Minister of Law and Human Rights Number M.HH-07.PR.01.03 Year 2020 concerning the Work System for State Civil Servants of the Ministry of Law and Human Rights;

    2) Carry out duties and functions while prioritizing the health and safety of officers by observing the Health protocol guidelines according to the Circular of the Minister of Health Number HK.01.07 / MENKES / 328/2020 concerning Guidelines for the Prevention and Control of Covid-19 in Office and Industrial Workplaces;

    3) Based on the Circular of the Director General of Immigration Number IMI-GR.01.01-0946 of 2020 concerning the Implementation of Immigration Duties and Functions in the New Habit Adaptation Period;

    4) Extension of Visit Stay Permit:
    a) Provide an extension of a Visit Stay Permit for foreigners who have obtained a Forced Stay Permit and are in the territory of Indonesia for a maximum of 5 (five) extensions since the enactment of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 26 of 2020 concerning Visas and Stay Permits in the New Habit Adaptation Period;
    b) For foreigners who hold a Visit Stay Permit originating from free visit visas, it cannot be extended and can be given a new Stay Permit after obtaining visa approval;
    c) Extension of residence permit prior to stipulation of Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 26 of 2020 concerning Visas and Stay Permits in the New Habit Adaptation Period, is not counted as an extension of Stay Permit;
    d) The period of extension of the Visit Stay Permit as referred to in letter a) is given no longer than 30 (thirty) days for each extension,
    e) Foreigners who have extended their stay permit for 5 (five) visits, as referred to in letter a) can be granted a new Stay Permit after obtaining Visa approval;
    f) In the event that a Foreigner who holds a Visit Stay Permit originating from a One-Time Visit Visa and Multiple-Trip Visit Visa and has extended a Visit Stay Permit as referred to in letter a), the status of a Visit Stay Permit can be changed to a Limited Stay Permit.

    5) Extension of Limited Stay Permit and Permanent Stay Permit
    a) Providing an extension of a Stay Permit for Foreigners who hold a Limited Stay Permit or Permanent Stay Permit who have obtained a Forced Stay Permit and are in Indonesian Territory based on a previous Limited Stay Permit or Permanent Stay Permit.
    b) Foreigners who hold a Limited Stay Permit or Permanent Stay Permit that cannot be extended in accordance with the provisions of legislation, can be granted a new Stay Permit after obtaining Visa approval,
    c) Receiving and forwarding the application for status change of Limited Stay Permit after the first extension of the Residence Permit.
    d) The period of time for a Limited Stay Permit is granted from the date of application / approval up to the period in accordance with the provisions of laws and regulations.
    e) Extension of a Limited Stay Permit can be made for a maximum of 6 (six) times or a maximum of 6 (six) years.

    6) Charging of Expenses
    Foreigners who extend their Residence Permit after October 5, 2020, may be subject to Immigration Administrative Measures in the form of expense.

  • Head of the Immigration Office in charge of Immigration Checkpoints:
    1) Performing supervision and control relating to immigration checks and issuing entry signs to:
    a) foreigners who already have a Visa for Multiple Trips and are still valid; and
    b) foreigners holding a Visit Visa in the context of developing the marina industry (yachter).

    2) Conduct and periodically report on the guidance, control and supervision of the implementation of Visa and Stay Permit policies during the New Habit Adaptation Period.
